財政部、國家發(fa)改委、人民(min)銀行、銀監會(hui)等四部委日前聯合下(xia)發(fa)通知,提出一系(xi)列措施(shi)制止(zhi)地方(fang)政府違(wei)法違(wei)規(gui)融資(zi)行為,并(bing)要求地方(fang)各級政府對相(xiang)關(guan)機構違(wei)法違(wei)規(gui)融資(zi)行為進行清理(li)整改。
盡管國務院(yuan)在(zai)2010年(nian)就發文要求地方(fang)各(ge)級政府加(jia)強融(rong)資平(ping)臺(tai)公(gong)司(si)管理,但隨著經濟(ji)形(xing)勢(shi)的變化,最近有(you)些(xie)地方(fang)政府違法違規融(rong)資有(you)抬(tai)頭(tou)之勢(shi),如違規采用(yong)集資、回購(BT)等方(fang)式舉債建設公(gong)益性項目,違規向融(rong)資平(ping)臺(tai)公(gong)司(si)注資或提(ti)供擔保等。
對此,四部(bu)委聯合(he)下發通(tong)知明確,地(di)方(fang)(fang)各(ge)級政府及所屬(shu)機關(guan)(guan)事(shi)業單位(wei)(wei)、社會團體(ti)等(deng)未(wei)經有(you)(you)關(guan)(guan)監(jian)管(guan)部(bu)門依法(fa)批準(zhun)不(bu)(bu)得(de)(de)直(zhi)接(jie)或(huo)間接(jie)吸收公眾資金進行公益(yi)性項目建設。除法(fa)律和國務(wu)院另(ling)有(you)(you)規定外,地(di)方(fang)(fang)各(ge)級政府及所屬(shu)機關(guan)(guan)事(shi)業單位(wei)(wei)、社會團體(ti)等(deng)不(bu)(bu)得(de)(de)以委托單位(wei)(wei)建設并(bing)承擔(dan)逐年回購(gou)(BT)責任等(deng)方(fang)(fang)式(shi)舉(ju)借政府性債(zhai)務(wu)。對符(fu)合(he)法(fa)律或(huo)國務(wu)院規定可以舉(ju)借政府性債(zhai)務(wu)的(de)公共租賃(lin)住房、公路等(deng)項目,確需采取代建制建設并(bing)由財政性資金逐年回購(gou)(BT)的(de),需落實(shi)分年資金償還(huan)計(ji)劃。
對于(yu)地(di)方融資(zi)平(ping)(ping)臺(tai)(tai)(tai)公(gong)(gong)司(si),通(tong)知(zhi)明確,地(di)方政府對融資(zi)平(ping)(ping)臺(tai)(tai)(tai)公(gong)(gong)司(si)注資(zi)必(bi)須合法合規(gui),不得將(jiang)政府辦公(gong)(gong)樓、學校、醫院、公(gong)(gong)園等公(gong)(gong)益性資(zi)產(chan)作(zuo)為(wei)資(zi)本注入融資(zi)平(ping)(ping)臺(tai)(tai)(tai)公(gong)(gong)司(si)。地(di)方政府將(jiang)土(tu)地(di)注入融資(zi)平(ping)(ping)臺(tai)(tai)(tai)公(gong)(gong)司(si)必(bi)須經過(guo)法定的(de)出讓(rang)或劃撥程序。地(di)方各級政府不得將(jiang)儲備土(tu)地(di)作(zuo)為(wei)資(zi)產(chan)注入融資(zi)平(ping)(ping)臺(tai)(tai)(tai)公(gong)(gong)司(si),不得承(cheng)諾將(jiang)儲備土(tu)地(di)預期(qi)出讓(rang)收(shou)入作(zuo)為(wei)融資(zi)平(ping)(ping)臺(tai)(tai)(tai)公(gong)(gong)司(si)償債(zhai)資(zi)金來源。
同時(shi),地方各級政府(fu)不(bu)(bu)得授權融(rong)(rong)資(zi)平(ping)臺公(gong)(gong)(gong)司(si)(si)(si)承擔(dan)土(tu)(tu)地儲(chu)(chu)備(bei)職能(neng)和(he)進行土(tu)(tu)地儲(chu)(chu)備(bei)融(rong)(rong)資(zi),不(bu)(bu)得將土(tu)(tu)地儲(chu)(chu)備(bei)貸款用(yong)于城市建(jian)設以及其他與土(tu)(tu)地儲(chu)(chu)備(bei)業(ye)務(wu)無關的(de)項目(mu)。符(fu)合條(tiao)件的(de)融(rong)(rong)資(zi)平(ping)臺公(gong)(gong)(gong)司(si)(si)(si)因(yin)承擔(dan)公(gong)(gong)(gong)共租賃住房(fang)、公(gong)(gong)(gong)路等公(gong)(gong)(gong)益性(xing)項目(mu)建(jian)設舉借需要財政性(xing)資(zi)金償還(huan)的(de)債務(wu),除法律和(he)國務(wu)院另(ling)有(you)規定外,不(bu)(bu)得向(xiang)非(fei)金融(rong)(rong)機構(gou)和(he)個人借款,不(bu)(bu)得通過金融(rong)(rong)機構(gou)中的(de)財務(wu)公(gong)(gong)(gong)司(si)(si)(si)、信托公(gong)(gong)(gong)司(si)(si)(si)、基(ji)金公(gong)(gong)(gong)司(si)(si)(si)、金融(rong)(rong)租賃公(gong)(gong)(gong)司(si)(si)(si)、保險公(gong)(gong)(gong)司(si)(si)(si)等直接或間(jian)接融(rong)(rong)資(zi)。
